1. Acceptance of Terms

By accessing and using the website, software, APIs, hosting, and related services provided by DP Info System ("Company", "we", "us", or "our"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, you are prohibited from using or accessing this site and our services.

2. Services Description & SLA

DP Info System provides custom software development, mobile application development, web hosting, VPS management, WhatsApp bulk messaging APIs, and IT hardware solutions.

Service Level Agreement (SLA): For managed hosting clients, we strive to provide a 99.9% uptime guarantee. However, we are not responsible for downtimes caused by force majeure events, upstream provider outages, or scheduled maintenance windows (which will be communicated 48 hours in advance).

3. Data Privacy and Security

We respect your privacy and are committed to protecting it. We do not collect and store data for personal use, and we absolutely do not sell data to any third parties. Furthermore, all data is saved securely in India data centers only, complying with strict local data residency laws.

4. Intellectual Property Rights

Unless otherwise stated in a separate custom software development contract, all intellectual property rights for the website design, text, graphics, underlying source code, and software frameworks developed by DP Info System remain the exclusive property of DP Info System. Upon full and final payment for custom project deliverables, the client is granted a perpetual, non-exclusive license to use the developed software for their business operations.

5. User Obligations

As a user of our services, you agree not to:

• Use the services for any illegal purpose or in violation of any local, state, national, or international law.
• Violate or encourage others to violate third-party rights, including intellectual property rights.
• Interfere with security-related features of our software or hosting infrastructure.
• Perform any fraudulent activity including impersonating any person or entity.

6. Limitation of Liability

In no event shall DP Info System, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any unauthorized access, use or alteration of your transmissions or content.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service.

8. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or the use of our services shall be subject to the exclusive jurisdiction of the courts located in Bhavnagar, Gujarat, India.
